The F-1 to H-1B Process Explained
Every Indian computer science student on F-1 OPT faces the same confusing transition. The dates, deadlines, and what happens if you're not selected are poorly explained online. If you are preparing backup plans in case the US lottery doesn't work out, explore the points-based Canada Express Entry CRS Calculator or check your qualifications with the Germany EU Blue Card Checker. Here's the complete picture of the F-1 to H-1B path.
OPT (12 months)
After graduating, you can apply for Optional Practical Training (OPT) — 12 months of work authorisation in your field. Apply 90 days before your graduation or program end date.
STEM OPT Extension (+24 months)
STEM degree holders can extend OPT by 24 additional months, giving 36 months total. Your employer must be E-Verify registered. Apply 90 days before initial OPT expires.
H-1B Lottery (March)
Your employer registers you in March. 85,000 slots are available from 780,000+ registrations (~14% odds). If selected, file petition by June 30 for October 1 start.
Cap-Gap Protection
If OPT expires before October 1 and your H-1B is pending, cap-gap protection automatically extends your F-1 status and work authorisation. No separate application needed.
Cap-Gap Explained
Cap-gap is the period between your OPT expiry and H-1B start (October 1). If your employer has a pending H-1B petition, you're protected — you can keep working. This is automatic and requires no action from you.
What to Do if Not Selected in the H-1B Lottery
Frequently Asked Questions
Can I work during cap-gap?
Yes. If your OPT expires between April 1 and September 30 while your H-1B petition is pending or approved, cap-gap protection extends your F-1 status and work authorisation through September 30.
What if I miss the H-1B lottery?
If not selected, consider: reapplying next year (your employer can register you again), exploring O-1 visa for extraordinary ability, L-1 via transfer to a Canadian office, or Canadian Express Entry which is increasingly popular for Indian IT professionals not selected in H-1B.
Can I apply for H-1B multiple times?
Yes. You can be registered for the H-1B lottery every year. There is no limit on the number of times you can try. If you have a Master's degree from a US university, you enter both the Master's cap (20,000) and general cap (65,000).
How does STEM OPT extension work?
If you have a STEM degree (science, technology, engineering, mathematics) and are working for an E-Verify registered employer, you can extend your OPT by 24 months. Apply 90 days before your initial OPT expires. Total STEM OPT: 12 months initial + 24 months extension = 36 months.
When does H-1B registration open?
USCIS opens H-1B registration in March each year (typically March 1–18). Employers register on your behalf during this window. Results come out in late March. H-1B start date is always October 1.
